1. Definitions
A domain is an area of the Internet hierarchical name space, which is denoted by
a unique domain name, served by a set of Domain Name Servers (DNS), and administered
autonomously by an Administrator. Each registered domain name is assigned a single
Administrator.
The Registry is the central database of the domain, which contains information
on the registered domain names and their Administrators, and other information required
for the domain registration.
A Registrar is a juristic person that provides services of domain name
registration and ensures delivery of the necessary information to the Registry.
An Applicant is a natural or juristic person that requests a service of domain
name registration and enters into an appropriate agreement with a Registrar.
Domain name registration means entry of the information about a domain name and
its Administrator on the Registry by a Registrar following an Applicant's Application. A
domain name is considered registered from the moment the information is entered on the
Registry. The registration term, during which the information on a domain name is stored
on the Registry, is one year. The registration of a domain can be repeatedly renewed for
another year.
The Administrator of a domain is the person in whose name the domain is
registered. The Administrator of a domain defines the rules and order of using the domain
name, is responsible for selecting the domain name and for possible infringement of the
rights of any third party in connection with the selection and use of the domain name, and
is liable for the costs of such infringements.
The Administration of a domain means definition, by the Administrator, of the
rules and order of using the domain name, and management and technical support of the
domain operation.
Registration termination (domain name vacation) is removal of the information on
a domain name and its Administrator from the Registry.
Domain delegation is placement and storage of the information about a domain
name and its domain name servers (DNS servers) on the root DNS servers of the SU domain,
which enables the operation of the domain on the Internet. The delegation of a domain is
only possible during the registration term of the domain.
An Application (Order) is a request of an Applicant to a Registrar which is made
on a form given by the Registrar and contains the information required for the
registration (renewing the registration) of a domain name.
The Personal account of a Customer's Agreement is a record of the Customer's
payments to RU-NIC as a Registrar, as well as the Customer's expenses for services
provided by RU-NIC. Any payment made by a Customer is added to the Personal account of
their Agreement after the money has been credited to RU-NIC's bank account and RU-NIC has
received from the bank a document identifying the payment.
Electronic payment system (e-payment system) is a system represented by software and hardware infrastructure, to settle
financial transactions between the Customer and RU-NIC via Internet.
2. General
2.1. RU-NIC fulfils its functions under contract No-18/NIC-L dated December 01,
2008 between RU-NIC and Autonomous Nonprofit Organization "Regional Network Information
Center", which provides services of domain name registration under the authority of
Agreement dated November 13, 2000 concluded between the Executive and DomainPeople Inc., which is the person authorized
to provide services of second-level domains registration within the .net, .com, and .org
TLDs.
2.2. The Executive takes obligations to promote the Customer's second-level
domains registration to its name and registration extension within the .net, .com, and
.org TLDs, and the Customer takes obligations to pay for the services rendered by the
Executive. The service of the domain name registration is considered rendered when the
information on the registered domain is entered into the .net, .com and .org TLDs' central
database.
2.3. Terms and conditions of rendering services of domains registration are set by
DomainPeople Inc. and are stated in the document "Registration Agreement". The
dispute policy is set in the document "Dispute Policy of Domain People
Inc.". The mentioned documents are published at the server by the address:
http;//www.nic.ru/.
2.4. The Customer agrees that any information the Customer provides by filling in
applications and other documents, including those in an electronic form, under sections of
these documents marked as "open", will be placed by RU-NIC on the search engines
and will be open to the general public. A list of the information that is bound to be
published and published with the Customer's consent, can be found at RU-NIC's Web server.
2.5. An Order for a service indicates that the Customer agrees to pay for the
service at the price effective at the date the processing of the Order begins.
2.6. A service is provided to a Customer based on the Agreement, so long as there
is an Order for the service and all applicable requirements of this Regulation are met.
2.7. A service of registration of a domain in the Net, Com, Org, Biz, Info, Name
domains is deemed provided from the moment the information on the domain and its
Administrator is entered on the Registry.
2.8. A service of renewing the registration of a domain in the Net, Com, Org, Biz,
Info, Name domain is deemed provided from the moment the information on the renewal is
entered on the Registry.
2.9. The Customer must comply with the requirements of the "Terms of Use" document,
which is published on RU-NIC's web site at http://www.nic.ru/about/servpol.html.
The Customer agrees that the Customer may be affected by any actions taken by RU-NIC
to prevent the negative effects of third party activity that impairs the operation
of RU-NIC's system of service provision. In doing so, RU-NIC will adhere to
the provisions of the "Terms of Use" document and will minimize such negative effects
on the Customer.
3. Conditions of domain registration and delegation
3.1. Conditions of domain registration
A domain cannot be registered in any of the following cases:
3.1.1. The domain name has already been registered.
3.1.2. The domain name reserved by the Registry.
3.1.3. The domain name does not meet any of the following requirements:
- the domain name must consist of more than three symbols, begin and end with a letter
of the Latin alphabet or a digit; the interjacent symbols may be letters, digits, or
hyphens; the 3rd and 4th symbols of the domain name cannot be both hyphens; the full
domain name includes the ".Net, .Com, .Org, .Biz, .Info, .Name" ending and
comprises no more than 64 symbols;
3.2. Conditions of domain delegation
3.2.1. To activate domain in the NET, COM, ORG, BIZ, INFO, NAME domain
it is enough at least one nameserver listed in the domain.
3.2.2. The information on domain name servers must correspond to the
current state of the network.
4. Processing of Orders for domain registration
4.1. Processing rules
4.1.1. Customers place Orders for new services using RU-NIC's Web interface.
The forms for the placement of Orders can be found at RU-NIC's Web server:
http://www.nic.ru
4.1.2. An Order for a new service can be cancelled by the Customer at
RU-NIC's Web server in the section "Manage your account"
(link "Processing queue, order removal") before the processing of the Order starts.
4.1.3. An order is processed if the funds in the Personal account
of the Agreement are sufficient to pay for all services of the Order.
Any Order that cannot be processed within 3 months will be deleted.
4.1.4. If there are several complete Orders for the same service from
different Customers, such Orders are processed on a first-come basis.
4.1.5. Different Orders for new services from a single Customer are
processed on a first-come basis. The sequence in which the Orders are processed
can be changed at RU-NIC's Web server in the section "Manage your account"
(link "Processing queue, order removal").
4.1.6. During the period of the reservation (blockage) of money in the
Personal account of an Agreement for a renewal of a service, an Order for
this renewal has priority in processing over any Orders for new services placed
by the same Customer.
4.1.7. RU-NIC send to DomainPeople Inc request for domain registration
wich contain the e-mail address from the Customer contract. After domain registration
DomainPeople Inc send the domain password to this e-mail address.
RU-NIC does not know this password.
4.2. Special provisions
4.2.1. All data provided by a Customer at the signing of the Agreement
and registration on RU-NIC's database must be factual. If a Customer submits
false information the registration may be terminated (the domain vacated).
4.2.2. If there is any doubt about the authenticity of data provided
by a Customer for the registration of a domain, RU-NIC may demand confirmation
of the data and/or request additional information during the entire term of
the registration. Such requests are sent via e-mail to the Customer's contact
address specified in the Agreement.
4.2.3. If the previously provided data is not confirmed and/or additional
information not provided within 10 calendar days from the moment of the first
request, RU-NIC may suspend the delegation of the Customer's domains. The
delegation of the domains can be resumed within 3 (three) working days after
receiving the required information.
If the required information is not provided within 20 (twenty) calendar days
from the moment of suspending the delegation the registration of the domains
is terminated.
4.2.4. Customer knows that he must read all the messages that RU-NIC
send to the e-mail address shown in the Customer contract.
4.2.5. Customer knows that the loss of the domain password caused to
the loss domain name management. To restore the domain name password Customer
should contact DomainPeople Inc.
5. Domain registration renewal
5.1. Renewing the registration of a domain ensures storage of the information
about the domain on the Registry for a period of one year.
5.2. The registration of a domain terminates if it is not renewed till the expiry
date. In case the registration will be renewed till the expiry date the delegation of the
domain will be resume.
5.3. In case the registration will not be renewed till the expiry date the domain name
will be deleted from the Registry.
5.4. Renewal procedure
5.4.1. An Order for renewing the registration of a domain is placed
by the Customer automatically two months prior to the end of the registration
term. At the same time, RU-NIC gives the Customer notice of the necessity
to renew the registration at the contact e-mail addresses specified in the
Customer's Agreement.
5.4.2. The registration of a domain will be renewed by RU-NIC if the funds
in the Personal account of the Customer's Agreement are sufficient to pay
for the service of renewal and if the Customer has not cancelled the renewal.
5.4.3. A Customer may cancel a renewal of the registration of a domain
at RU-NIC's Web server in the section "Manage your account" (link
"Renew services") before the service of renewal is provided. After
that the Customer will still be able to consent to the renewal at any time
before the termination of the registration.
5.4.4. The fact that a Customer has not cancelled a renewal of the registration
of a domain confirms the Customer's consent to the provision of the service
of renewal and to the debiting of the Agreement's Personal account for the
renewal. The Personal account of a Customer's Agreement is debited according
to Section 6 of this Regulation.
6. Payment for services. Principles of debiting the Personal
account of an Agreement
6.1. The cost of RU-NIC's services is specified in the Service Agreement.
6.2. Invoicing
6.2.1. RU-NIC will invoice a Customer upon receiving an appropriate request
from the Customer. The request for an invoice is made by the Customer at RU-NIC's
Web server in the section "Manage your account". On condition that
the Customer has signed an Agreement with RU-NIC, the original of the invoice
will then be sent to the Customer by post:
- within 3 (three) working days after RU-NIC receives the Customer's
request for the invoice - if the Customer is a juristic person;
- as requested by the Customer - if the Customer is a natural person.
A copy of an invoice can be printed by the Customer at RU-NIC's Web server
in the section "Manage your account".
6.2.2. A Customer has to put the number of their Agreement with RU-NIC in
the "Payment Subject" section of any payment document prepared by
the Customer.
6.3. Payment for services from the Personal account of a Customer's Agreement
6.3.1. RU-NIC keeps a record of a Customer's payments and the services provided
to the Customer, according to the actual prices of these services, as the
Personal account of the Customer's Agreement. Any payment made by a Customer
is added to the Personal account of their Agreement after the money has been
credited to RU-NIC's bank account and RU-NIC has received from the bank a
document identifying the payment.
A Customer can access the information on the Personal account of their Agreement
at RU-NIC's Web server in the section "Manage your account" (link
"Account balance").
6.3.2. RU-NIC provides a Customer with a service after reserving (blocking)
sufficient money in the Personal account of the Customer's Agreement. Money
that is blocked for a service cannot be used to pay for another service.
If money is blocked to pay for a service of domain registration, the Customer
cannot remove the blockage.
If money is blocked to pay for renewing a service, the Customer can remove
the blockage by cancelling the renewal. Money may be unblocked before
the renewal service is provided to the Customer. A renewal of a service can
be cancelled at RU-NIC's Web server in the section "Manage your account"
(link "Renew services").
6.3.3. Reservation of money in the Personal account of a
Customer's Agreement
6.3.3.1. The funds for several new services of domain registration
ordered by the same Customer are blocked in the sequence in which the Orders
for these services are placed.
The sequence in which Orders for new services are processed can be changed
by the Customer at RU-NIC's Web server in the section "Manage your
account" (link "View and change data"). If a Customer changes
the sequence in which the Orders for new services are processed, the funds
for the new services will be blocked in this new sequence.
6.3.3.2. The funds for renewing several services of domain registration
ordered by the same Customer are blocked in the sequence in which the terms
of these services expire (the funds for a service whose term expires earlier
are blocked earlier), unless if otherwise specified by the Customer using e-payment systems. In this case
the service renewal procedure will be established by the Customer as scheduled by the e-payment
systems.
6.3.3.3. The funds for a new service may only be blocked after the
reservation of money for renewing all the Customer's services whose renewal
requires such reservation immediately and has not been cancelled by the
Customer (reservation of money for renewing any existing service has priority
over the reservation of money for any new service).
The period of the reservation of money for a service, as well as the rules
of this reservation, are specified in the Regulation governing the service.
6.3.3.4. The funds for renewing a service of domain registration are
blocked in the Personal account of the Customer's Agreement not earlier
than 37 (thirty seven) calendar days before the term of the service
ends, if the Customer has not cancelled the renewal.
6.3.4. The funds for renewing a service of domain registration are debited
automatically by RU-NIC from the Personal account of the Customer's Agreement not earlier than 30 (thirty)
calendar day before the term of the service ends, if the Customer has not
cancelled the renewal.
6.3.5. On the Customer's initiative
money charging off from his Service Agreement personal account for domain name
registration service renewal can be executed before the terms specified in the
paragraph 6.3.4 of the present Schedule, but not earlier than 3 (three)
months before the registration expires. In such case money charging-off is made within 24
hours since the Customer's consent to pay in advance for
domain name registration renewal is received by RU-NIC. The Customer can
confirm his agreement for ahead of schedule renewal payment on RU-NIC's
web-server in the section "Manage your account" (the link "Services renewal").
6.4. Upon termination of an Agreement, or if a Customer provides reasons why the
Customer cannot use RU-NIC's services, the remainder of the Customer's money is returned
to the Customer by bank transfer to the Customer's account at any bank in the Russian
Federation. RU-NIC will take all actions that are necessary for the return within
7 (seven) working days from the date RU-NIC receives the Customer's written request
with full information on the payee's bank account.
7. Modifying parameters of a domain name information
Domain name information - is the data about registrant, Admin, Bill, Tech
Contacts, DNS servers, password.
7.1. The data of an Administrator or t a domain registration service can only be
modified after the Order for registration of the domain is processed.
7.2. Terms of modifying parameters of a domain name information
7.2.1 Any modifications are made at DomainPeople's Web server by going to
the "Client Login" section.
7.2.2. The changes become active in 48 hours.
8. Registrant Change
8.1. Domain transfer to another juristic or natural person
is made according to the rules defined by DomainPeople, Inc.
8.2. Current and new domain name Registrants make Registrant change operations
at DomainPeople Web-server: https://www.domainpeople.com/customerlogin.htm
9. Registrar Transfer
9.1. The Administrator of a domain may transfer the responsibility to enter
information about the domain name and its Administrator on the Registry to a new Registrar
not earlier than 60 (sixty) calendar days after the registration of the domain.
9.2. The responsibility to enter information about a domain name and its
Administrator on the the Registry can be transferred to RU-NIC from another Registrar
through an official letter of the Administrator to RU-NIC. The Procedure how to change the
Registrar to DomainPeople Inc and serve the domain under service agreement with RU-NIC is
given at RU-NIC's Web server.
