Third-level Domains Registration Schedule1. Definitions A Domain is an area of the Internet hierarchical name space, which is denoted by a unique domain name, served by a set of Domain Name Servers (DNS), and administered autonomously by a Registrant. Each registered domain name is assigned to a single Registrant. The Registry is the database of the second level domain, which contains information on the registered third-level domain names and their Registrants, and other information required for the third-level domain registration. Second-level domain Sponsor is a legal entity, in whose name the domain is registered, delivering registration services of third-level domain names and providing entry of records into the Registry about a domain name and its Registrant (domain maintenance). The Contractor (RU-NIC) - Joint Stock Company "RU-CENTER". A Customer - a person or a legal entity, which made an order to RU-NIC to service. RU-NIC's Partner - a person involved in RU-NIC's partnership program (party under the Multiple Service Contract, index NIC-REG). Domain name registration means entry of the information about a third-level domain name and its Registrant on the Registry by a RU-NIC following an Applicant's Application. A third-level domain name is considered registered from the moment the information is entered on the Registry. The registration term, during which the information on a third-level domain name is stored on the Registry, is one year. The registration of a third-level domain can be repeatedly renewed for another year.
The third-level domain Registrant (domain name owner) is the person in whose name the third-level domain is registered. The third-level domain Registrant defines the rules and order of using this domain name, is responsible for selecting the domain name and for possible violations of the rights of any third party in connection with the selection and use of the domain name, and is liable for the costs of such violations. The Administration of a third-level domain means definition, by the third-level domain Registrant, of the rules and order of using the third-level domain name, management and technical support of the domain operation. Cancellation of registration is removal of the information on a third-level domain name and its Registrant from the Registry. Third-level domain delegation is placement and storage of the information about a third-level domain name and its domain name servers (DNS servers) on the root DNS servers of the RU domain, which enables the operation of the third-level domain on the Internet. The delegation of a third-level domain is only possible during the registration term of this domain. An Application (Order) is a request of an Applicant to RU-NIC which is made on a form given by the RU-NIC and contains the information required for the registration (registration renewal) of a third-level domain name. Customer's Contract Account is a record of the Customer's payments to RU-NIC as a Registrar, as well as the Customer's expenses for services provided by RU-NIC. Any payment made by a Customer is added to the Personal account of the Service Agreement after the money has been credited to RU-NIC's bank account and RU-NIC has received from the bank a document identifying the payment. Blocking of Funds on Customer's Contract Account - reservation of an amount on the Customer's contract account for the purpose of its further withdrawal on account of service delivery or renewal. The funds reserved for the service delivery or renewal may not be used for payment of other services. Electronic payment system (e-payment system) is a system represented by software and hardware infrastructure, to settle financial transactions between the Customer and RU-NIC via Internet. Note: The terms uncovered by this Schedule are defined in document "Third-level Domains Maintenance Policy". 2.1. RU-NIC, as a sponsor of second-level domains RU.NET, EXNET.SU, provides the services for renewal of domain names registration in third-level domains in RU.NET, EXNET.SU. 2.3. RU-NIC provides services to a Customer that has registered on RU-NIC's database. The Customer is responsible for selecting and registering individual administrative and technical passwords during the registration on the database, for securing their confidentiality, and for all actions that involve using the passwords. 2.4. A Customer agrees that any information the Customer provides by filling in applications and other documents, including those in an electronic form, under sections of these documents marked as "open", will be placed by RU-NIC on the search engines and will be open to the general public. A list of the information that is bound to be published and published with the Customer's consent, can be found at RU-NIC's Web server. 2.5. The Customer and RU-NIC acknowledge the legal effect of notifications and messages, sent by RU-NIC to the Customer's e-mail addresses, specified by the Customer in the Service Agreement and other documents. Such notifications and messages are equal to messages and notifications in writing, sent by RU-NIC to Customer's mail addresses. The Customer and RU-NIC, in case of any disagreements concerning the facts of sending and receiving messages, the time of sending, contents of the messages, agreed to consider evidences of RU-NIC's archive service binding and definitive for settlement of disputes between indicated parties. 2.6. An Order for a service of domain name registration in the RU domain confirms that the Customer of a domain agrees with "Rules of domain names registration under RU domain" and the procedure of its modification. The document is available at http://www.nic.ru/dns/contract/. An Order for a service indicates also that the Customer agrees to pay for the service at the price effective at the date the processing of the Order begins. 2.7. A service of third-level domain name registration is deemed provided from the moment the information on the third-level domain and its Registrant is entered on the Registry. 2.8. A service of renewing the registration of a third-level domain is deemed provided from the moment the information on the renewal is entered on the Registry. The domain registration is prolonged on 1 (one) year from earlier installed date of completions a term of registrations. 2.9. The Contractor shall inform the Customer on the fact of rendering the service by an e-mail sent to the Customer address. If the motivated Customer's objections set forth in simple language in writing and sent by mail service failed to reach the Contractor's address within 15 (fifteen) calendar days from the date of the abovementioned Contractor's e-mail, the service rendered to the Customer by the Contractor is considered to be accepted by the Customer. 2.10. The form of any official letter is set by RU-NIC and is available at its web-server http://ww.nic.ru/. The letters should be sent to the following address: Regional Network Information Center, for the attention of the director 2.11. A Customer shall follow requirements of Terms of Use which are available at RU-NIC's server http://www.nic.ru/about/en/servpol.html. The Customer agrees that he could be affected by consequences of actions applied by RU-NIC for prevention of the adverse effects of third party activity impairing the operation of RU-NIC Service system. In its actions RU-NIC follows provisions of Terms of Use and guarantees the minimization of such adverse effects to the Customer. 3. Registration and Delegation Terms 3.1. Registration Terms
3.1.1. RU-NIC registers a domain name upon receipt from the Customer an Order which is ready to be processed in accordance with paragraph 4.3 of this Schedule. 3.1.2. A third-level domain name cannot be registrated in any of the following cases: 3.1.2.1. The third-level domain name has already been registered. 3.1.2.2. The third-level domain name does not meet any of the following requirements:
3.1.2.3. Subject to the sections 3.3.3 and 4.9. 3.2. Delegation Terms 3.2.1. A third-level domain may only be delegated with the DNS
servers list specified by the Customer after receiving positive results of
a validity check on the domain name servers (primary and secondary DNS
servers) that, as specified by the Customer, hold the configuration files
of the third-level domain. If positive results of the validity check on the third-level domain name servers are not received within 4 (four) days, the check is ceased. The procedure of testing the DNS servers can be initiated again by the Customer using RU-NIC's Web interface. 3.2.2. The information on third-level domain name servers must correspond to the current state of the network. 3.2.3. In the case of any breach of the provisions in the sections 3.2.1 and 3.2.2 hereinabove, RU-NIC may suspend the delegation of a domain at any time during the registration term. The delegation can only be resumed after the breach is corrected. 3.3. Special provisions 3.3.1. All data provided by a Customer for the moment of signing of the Service Agreement and registration on RU-NIC's database must be factual. If a Customer submits false information the registration may be terminated. 3.3.2. If there is any doubt about the authenticity of data provided by a Customer for the registration of a third-level domain, RU-NIC may demand confirmation of the data and/or request additional information during the entire term of the registration. Such requests are sent via e-mail to the Customer's contact address specified in the Service Agreement. 3.3.3. If the previously provided information is not confirmed and/or additional information is not provided within the term specified by RU-NIC in the respective request, RU-NIC may: a) reject Customer's application for new third-level domain name registration; The said restrictions could be canceled within 3 (three) working days after receiving the required information. If the required information is not provided within 60 (sixty) calendar days from the moment of suspending RU-NIC is entitled to cancel registration of the Customer's third-level domain names. 3.3.4. To transfer a third-level domain name to another juristic or natural person, to cancel a third-level domain name registration upon the Customer request the Customer must provide RU-NIC with documents which are published at www.nic.ru web-server appropriate sections. All Customer identifying data specified in the provided documents must be identical to the data specified by the Customer while registering in RU-NIC's database. 3.3.5. Cancellation of third-level domain name registration before registration term is expired 3.3.5.1. The registration of a third-level domain name is terminated before the expiry of the registration term in the following cases: a) by reason of the Registrant's written request with the
exception of cases described in 3.3.5.2 section of this Schedule;
In such cases, the person whose rights the court has found infringed is given priority in registration of the cancelled third-level domain name. To realize its priority the person shall send a written request to RU-NIC's address not later than 60 (sixty) calendar days after the court decision becomes effective. d) Subject to the section 3.1.2.2. 3.3.5.2. Third-level domain name registration will not be canceled before its expiry term upon a written request of the Registrant within 60 (sixty) calendar days after: - obtaining third-level domain ownership by the Registrant from another person, or
4.1. Customers place Orders for new services using RU-NIC's Web interface. The forms for the placement of Orders can be found at RU-NIC's Web server: http://www.nic.ru 4.2. An Order for a new service can be cancelled by the Customer at RU-NIC's Web server in the section "Manage your account" (link "Processing queue, order removal") before the processing of the Order starts. 4.3. An order is processed if the funds in the Personal account of the Agreement are sufficient to pay for all services of the Order. Any Order that cannot be processed within 3 months will be deleted. 4.4. If there are several Orders for the same service from different Customers, such Orders are processed on a first-come basis. 4.5. Different Orders for new services from the Customer are processed on a first-come basis. The sequence in which the Orders are processed can be changed at RU-NIC's Web server in the section "Manage your account" (the link "Processing queue, order removal"). 4.6. During the period of the reservation of money in the Personal account of an Agreement for any service renewal, an Order for this renewal has priority in processing over any Orders for new services placed by the same Customer. The Customer has to submit the data necessary for providing the service within the term, specified by RU-NIC. 4.7. RU-NIC examines Orders for the compliance with the conditions set forth in this Schedule. During the period of examination of an Order RU-NIC may request the Customer to provide additional information required for the examination. 4.8. RU-NIC's decision to register a third-level domain name or to refuse the registration will be based on a reason provided for in this Schedule. 4.9. If there is any doubt, for a reason specified in this Schedule, whether the registration of a third-level domain is possible, RU-NIC may suspend the registration of the third-level domain name for a period of 15 (fifteen) days. After that RU-NIC must register the third-level domain or issue a reasoned refusal of the registration. 4.10. If there is a reason for the refusal of registration RU-NIC will inform the Customer about the impossibility of the third-level domain name being registered and the reason for this refusal. RU-NIC, whenever possible, may choose not to refuse third-level domain registration, but to register it in RU-NIC's name with further domain transfer to the Customer since the latter meets the requirements of the present Schedule. 4.11. A decision about registration, refusal of registration, or registration suspension is sent to the Customer within 2 (two) working days from the moment the processing of the Order begins. 5.1. A third-level domain name registration renewal ensures storage of the information concerning the domain name on the Registry for the period of one year. 5.2. The fact that a Customer has not cancelled a renewal of the registration of a third-level domain confirms the Customer's consent to the provision of the service of renewal and to the debiting of the Service Agreement's Personal account for the renewal. 5.3. Renewal procedure 5.3.1. An Order for renewing the registration of a third-level domain is placed by the Customer automatically two months prior to the end of the registration term. At the same time, RU-NIC gives the Customer notice of the necessity to renew the registration at the contact e-mail addresses specified in the Customer's Agreement. 5.3.2. The registration of a third-level domain will be renewed by RU-NIC if the funds in the Personal account of the Customer's Agreement are sufficient to pay for the service of renewal and if the Customer has not cancelled the renewal. 5.4. A Customer may cancel a renewal of the registration of a third-level domain at RU-NIC's Web server in the section "Manage your account" (link "Renew services") before the service of renewal is provided. After that the Customer will still be able to consent to the renewal at any time within thirty (30) calendar days after expiration. 5.5. If a third-level domain name registration is not renewed by the Customer before its expiry date, domain delegation with the list of DNS servers specified by the Customer will be suspended by RU-NIC upon registration expiry term. In this case start and end moments of third-level domain delegation suspension will be fixed by RU-NIC under the procedure published on its web-server. From the moment of third-level domain delegation suspension with the list of DNS servers specified by the Customer, all http queries to the Customer's domain may be redirected to RU-NIC's service page to inform about temporary suspension of the service. If the third-level domain name renewal is paid within thirty (30) calendar days after expiration and Customer does not decline renewal order, the third-level domain name registration term is extended for 1 (one) year from expiration date and the third-level domain is reactivated within 2 (two) business days after the payment received. 5.6. RU-NIC terminates the registration of a third-level domain if it is not renewed by the Customer within 30 (thirty) calendar days from the date the registration term of the third-level domain ends. 5.7. A third-level domain name registration is not extended by RU-NIC subject to the section 3.3.3 hereinabove. 6.1. The cost of services is specified in the Service Agreement. 6.2. RU-NIC keeps a record of Customer's payments and the services provided to the Customer, according to the actual prices of these services, as the Personal account of the Customer's Service Agreement. Any payment made by a Customer is added to the Personal account after the money has been credited to RU-NIC's bank account and RU-NIC has received from the bank a document identifying the payment. A Customer can access the information on the Personal account of their Agreement at RU-NIC's Web server in the section "Manage your account" (link "Account balance"). 6.3. Invoicing 6.3.1. RU-NIC will invoice a Customer upon receiving an appropriate request from the Customer. The request for an invoice is made by the Customer at RU-NIC's Web server in the section "Manage your account". On condition that the Customer has signed a Service Agreement with RU-NIC, the original of the invoice will be sent to the Customer by post:
A copy of an invoice can be printed by the Customer at RU-NIC's Web server in the "Manage your account" section. 6.3.2. A Customer shall put the number of their Contract with RU-NIC in the section "Payment Subject" of any payment document prepared by the Customer. 6.4. Customer's Money Reservation 6.4.1. RU-NIC provides a Customer with a service after reserving sufficient money in the Customer's Contract Account. Money that is reserved for a service cannot be used to pay for another service. 6.4.2. If money is blocked to pay for renewing a service, the Customer can remove the blockage by cancelling the renewal. Money may be unblocked before the renewal service is provided to the Customer. A renewal of a service can be cancelled at RU-NIC's Web server in the "Manage your account" section (link "Renew services"). 6.4.3. The funds for new services of domain registration ordered by the same Customer are blocked in the sequence, in which the Orders for these services are placed. 6.4.4. The funds for a new service may only be blocked after money reservation for renewing all the Customer's services, whose renewal requires such reservation immediately and has not been cancelled by the Customer (reservation of money for renewing any existing service has priority over the reservation of money for any new service). 6.4.6. If several Orders for domain renewal are placed by the Customer, the funds for the services are blocked in the sequence in order expiration date (the funds for a service whose term expires earlier are blocked earlier), unless if otherwise specified by the Customer using e-payment systems. In this case the service renewal procedure will be established by the Customer as scheduled by the e-payment systems. 6.5. The funds for domain renewal are blocked automatically by RU-NIC on the Customer's Contract Account not earlier than 8 (eight) calendar days before the term of the service ends, if the Customer has not cancelled the renewal. The funds for domain renewal are withdrawn automatically by RU-NIC from the Customer's Contract Account not earlier than 1 (one) calendar day before the term of the service ends, if the Customer has not cancelled the renewal. 6.6. On the Customer's initiative money blocking and withdrawal from his personal account for domain name registration renewal can be executed by RU-NIC before the terms set forth in paragraph 6.5 hereinabove, but not earlier than 2 (two) months before the registration expires. In such case money blocking and withdrawal is made within 24 hours since the Customer's consent to pay in advance for domain name registration renewal is received by RU-NIC. The Customer can confirm his agreement for premature renewal payment on RU-NIC's web-server in the "Manage your account" section (link "Services renewal"). 6.7. Upon termination of a Service Agreement, or if a Customer provides reasons why the Customer cannot use RU-NIC's services, the remainder of the Customer's money is refunded to the Customer by bank transfer to the Customer's account at any bank in the Russian Federation. RU-NIC will take all-out actions to make a refund within 10 (ten) working days from the date RU-NIC receives the Customer's written request with full information on the payee's bank account. 6.8. There will be no refund of the fee for any unexpired period of a cancelled domain name registration. 6.9. Customer's obligations for services payment will be deemed unexecuted, if he (she) made a refund upon the request of the payment system, by which the Customer paid for the service. In this case RU-NIC is entitled to suspend the service for the Customer since the moment of refund, and use the domain name at its own discretion. 7.1. Updating DNS servers Any updates may be introduced at RU-NIC's web server in the following sequence:
7.2. Updating Registrant's Data in the Registry The Registrant's data in the Registry are updated by modifying
the data in
the Registrant's Agreement with RU-NIC. 7.3. Updating a Customer's data in the Agreement The Customer's contact and identification data (hereinafter referred to as Customer's data) in the Agreement with RU-NIC may only be modified after the Order for registration of the third-level domain has been successfully processed. The Customer shall thereby ensure the authenticity of any data provided as part of the Agreement. 7.3.1. Updating Customer's Contact Data The Customer's contact data are: telephone number, fax number, e-mail addresses, postal address. Any updates are initiated at RU-NIC's Web server by:
The Customer's contact data updates will take effect within 1 (one) hour since their introduction. 7.3.2. Updating Customer's Identification Data The Customer's identification data are:
Identification data are updated through an official letter from
the Customer to RU-NIC. The form
of the letter is available at RU-NIC's Web server. RU-NIC, upon receipt of such a letter from the Customer, shall update the Customer's identification data in the Agreement within 2 (two) working days and notify the Customer thereof. 7.4. Customer's Data Update to Display in Search Engines 7.4.1. Update of Customer's Identification Data If a Registrant is an individual, he (she) may add privacy to his (her) identification data in search engines. In such cases field "person" in search engines will display "Private Person" inscription. For any updates to RU-NIC's Web server:
The data in the Registry will be automatically updated within 2 (two) hours upon making appropriate modifications in the identification data. 7.4.2. Update of Customer's Contact Data The Registrant may specify contact data, other than those specified the contract, with RU-NIC (telephone number, fax number, e-mail address) to make them available to public.
The data in the Registry will be automatically updated within 2 (two) hours upon making appropriate modifications in the contact data. 8. Third-level domain Transfer 8.1. A third-level domain name is transferred to another individual or legal entity on the basis of an notification from the third-level domain Registrant to RU-NIC. Sample notifications (letters) and requisite documents for domain transfer are available at RU-NIC's web server in the "Services" section. 8.2. If RU-NIC receives a notification (letter) from the third-level domain Registrant requesting a transfer of the third-level domain to another individual or legal entity, as well as a confirmation from the individual or legal entity to become the Registrant of this third-level domain, in the form set by RU-NIC, RU-NIC will transfer the third-level domain within 2 (two) working days and give the previous and new Registrants an appropriate notice. At RU-NIC's discretion this term could be extended till 30 calendar days. 8.3. Transfer of a third-level domain name to another individual or legal entity does not affect the term of the registration. 8.4. A confirmation to become the Registrant from the person, issued in the form set by RU-NIC and received by RU-NIC from this person, shall be deemed as a consent to fulfill the terms and provisions hereunder. 8.5. A third-level domain transfer may be considered void by RU-NIC, provided there are sufficient grounds therefore. 8.6. A third-level domain name transfer to another Registrar is not provided by RU-NIC: a) subject to the section 3.3.3 hereinabove; 9.1. No second level domain Registrant's (Contractor's) transfer for third-level domains is provided. 10. RU-NIC - Partner & Partner - RU-NIC Transfer Procedure 10.1. A Customer may receive RU-NIC's services from RU-NIC Partner (hereinafter referred to as "Partner"). 10.2. A Customer can transfer the responsibilities to provide a Customer with RU-NIC's services of third-level domain name registration and renewal:
by submitting an official document or by submitting request through the RU-NIC's web-server, section "Manage your account" ("Contract"). Such an official letter or a request from the third-level domain Registrant shall be deemed consent to enter into new Registration Agreement with RU-NIC and to the full terms and conditions hereunder. 10.3. If RU-NIC receives such an official letter from a Customer, RU-NIC
will transfer the responsibilities specified in paragraph 10.2 within 2
(two) working days. 10.4. From the moment the responsibilities specified in paragraph 10.2 are transferred from RU-NIC to Partner, the contractual relations between RU-NIC and the Customer, are suspended. If the responsibilities set forth in para 10.2 are transferred by the Customer's initiative from a third person to RU-NIC, under the form established by RU-NIC, the contractual relations between RU-NIC and the Customer are resumed. |
